Previous refusal or cancellation of registration
Section 47(1)(c) of the Education Act provides that any refusal to register, or cancellation of registration, of the school, or any other school under section 56 and 59, occuring during the period of five (5) years immediately before the application for registration is made has not been largely attributable to the actions of a 'responsible person' or proposed 'responsible person' for the school, or any other person or body having similar functions in relation to the management or operation of the school to those of a 'responsible person'.
Evidence of compliance
The approved authority for a registration system must have in place processes of notification and disclosure by which the system and/or member school can assure NESA that any refusal or cancellation of registration in relation to a non-government school or proposed non-government school in the past five (5) years has not been largely attributable to the actions of a 'responsible person' for a school.
