Amendments to the Manuals

Effective: 1 January 2022
The non-government school registration manuals have been amended to reduce compliance and administrative burden on schools and teachers.
To ensure schools and teachers can take advantage of the amendments as soon as possible, implementation of the new manuals will commence from 1 January 2022.
The requirements for registration and accreditation are detailed in the registration manuals:

- Registration Systems and Member Non-government Schools (NSW) Manual

NESA’s registration Manuals have been updated as a result of the introduction of the Children’s Guardian Act 2019 effective from 1 March 2020.
The Children’s Guardian Act 2019 transfers the reportable conduct scheme from the NSW Ombudsman to the Children’s Guardian.
All schools and schooling systems need to review and update their policies and procedures in relation to reportable conduct to ensure that the monitoring, investigating and reporting of reportable conduct complies with the requirements of the Children’s Guardian.
The Children’s Guardian Act 2019 builds on the NSW Government’s response to the Royal Commission into Institutional Responses to Child Sexual Abuse. It consolidates the powers and functions of the Children’s Guardian into one Act. This includes the Children’s Guardian’s powers in relation to out-of-home care, adoption, children’s employment, reportable conduct and official community visitors.
Information about the Children’s Guardian Act 2019 is published on the Children’s Guardian website.

The Registered and Accredited Individual Non-government Schools (NSW) Manual, theRegistration Systems and Member Non-government Schools (NSW) Manual and the Registration Process for the NSW Government Schooling System Manual have all been amended.
The amended Manuals are approved by the Minister for Education and Early Childhood as rules of NESA under section 25 of the Education Standards Authority Act 2013.
Between March and June 2019, key stakeholders reviewed the evidence of compliance in the Manuals from a risk perspective.
The resulting amendments to the Manuals reduce and clarify the required evidence of compliance that must be maintained in relation to:
- student leadership systems
- resources and equipment
- facilities
- educational and financial reporting

The Registered and Accredited Individual Non-government Schools (NSW) Manual, the Registration Systems and Member Non-government Schools (NSW) Manual and the Registration Process for the NSW Government Schooling System Manual(the Manuals) have been amended.
The amended Manuals have been approved by the Minister for Education as rules of NESA under section 25 of the Education Standards Authority Act 2013.
The amendments take effect with the publication of this Official Notice.
The reason for amending the Manuals is to respond to the NSW Government’s acceptance of Recommendation 37 from the Parliamentary inquiry into the provision of education to students with a disability or special needs in government and non-government schools in NSW. Accordingly, the child protection section of the Manuals has been amended to require schools to set clear guidelines and expectations for stakeholders regarding complaints or allegations of staff misconduct or reportable conduct and to publish the school’s complaint handling procedures regarding allegations of staff misconduct or reportable conduct.
Amendments to reflect Recommendation 37 apply to:
- sections 3.6.1, 3.11.4 and 4.4.6.1 of the Manual for individual non-government schools
- sections 5.6.1, 5.11.4 and 6.1.6.1 of the Manual for systemic non-government schools
- section 4.4.1 of the Manual for government schools.
Other amendments to the Manuals have also been approved to:
- update nomenclature and formatting
- update links for various Acts
- update glossary terms and definitions
- make minor edits for accuracy and to ensure internal consistency.

Official Notice NESA 06/18 provides amendments to the Registration Process for the NSW Government Schooling System Manual, the Registered and Accredited Individual Non-government Schools (NSW) Manual and the Registration Systems and Member Non-government Schools (NSW) Manual (‘the Manuals’).

In December 2017, NESA published amendments to the school registration manuals for all sectors in relation to the quality of student learning.
The manuals for non-government schools were also amended in relation to provisions for conditions to be imposed on the registration of a non-government school (see NESA Official Notice 58/17).
The manuals are:
- Registration Process for the NSW Government Schooling System Manual
- Registered and Accredited Individual Non-government Schools (NSW) Manual
- Registration Systems and Member Non-government Schools (NSW) Manual.
A supplementary document, Guidelines for Conditions of Registration was also published. The Guidelines identify when conditions might be applied, the process for applying conditions and some examples of conditions that may be considered.
The amended Manuals took effect with the publication of Official Notice 58/17.

Official Notice NESA 58/17 provides amendments to the Registration Process for the NSW Government Schooling System Manual, the Registered and Accredited Individual Non-government Schools (NSW) Manual and the Registration Systems and Member Non-government Schools (NSW) Manual (‘the Manuals’).
Quality of student learning
From 1 January 2017, changes to the Education Act 1990 (‘the Act’) became effective so that under section 47(2) of the Act, NESA is to have regard to matters relating to the quality of student learning in deciding whether the requirements for school registration are being met. Section 27A of the Act provides for NESA to have regard to the same matters with respect to government schools.
In July 2017, the Manuals were amended to provide further elaboration for schools and schooling systems in relation to the regulatory focus on the quality of student learning (see NESA Official Notice 27/17 Amendments to Government and Non-Government School Registration Manuals).
As a result of consultation conducted in Terms 3 and 4 in 2017, further amendments have been made to clarify school registration requirements relating to the quality of student learning.
The amendments relate to the requirements for teaching staff, curriculum, facilities and student welfare, in particular student attendance.
The amendments apply to:
- section 4 of the Manual for the government schooling system
- sections 3, 4, 5 and 6 of the Manual for individual non-government schools
- sections 5, 6, 7 and 8 of the Manual for systemic non-government schools.
Conditions of registration
In 2017, changes to the Act became effective providing for the Minister to impose conditions on the registration of a non-government school.
Accordingly, the Manuals for non-government schools were updated in January 2017 with the view to providing further elaboration later in 2017.
The Manuals have now been amended further to provide more detail about the process for imposing conditions on registration, including the right to seek an internal review of a recommendation to impose conditions.
Publication of the amended Manuals
The amended Manuals take effect with the publication of Official Notice 58/17.

Official Notice NESA 27/17 provides amendments to the Registration Process for the NSW Government Schooling System Manual, the Registered and Accredited Individual Non-government Schools (NSW) Manual and the Registration Systems and Member Non-government Schools (NSW) Manual (‘the Manuals’).
The amendments relate to the regulatory focus on the quality of student learning for all NSW schools and schooling systems.
The Education Act 1990 states that the quality of student learning includes, but is not limited to, the following matters:
- the standard of teaching of courses of study provided at the school
- student engagement in learning at the school
- any matters identified in a risk assessment conducted by NESA in relation to the school.
These matters are most relevant to the registration requirements for teaching staff, curriculum, facilities and student welfare, in particular student attendance.
The amended Manuals relate to these requirements and specify the evidence of compliance to be maintained by schools.
The amendments apply to:
- section 4 of the Manual for the government schooling system
- sections 3, 4 and 5 of the Manual for individual non-government schools
- sections 5, 6 and 7 of the Manual for systemic non-government schools.
The amended Manuals take effect with the publication of this Official Notice.
The relevant provisions of the amended Manuals will be the basis of inspections of schools selected randomly in relation to ‘Strand B – Quality of Student Learning’ in Terms 3 and 4, 2017. Official Notice 26/17 provides more information about these inspections.
The evidentiary requirements for the quality of student learning in the Manuals are transitional and will be subject to further consultation with key stakeholders prior to the end of Term 4, 2017. This will allow for any refinements to be published prior to full implementation for all schools on the 2018 school inspection program. Official Notice NESA 17/17 provides notice of amendments to the Registered and Accredited Individual Non-government Schools (NSW) Manual and the Registration Systems and Member Non-government Schools (NSW) Manual with regard to the new registration requirement for financial viability.
The amendments provide further guidance for schools and identify the evidence to be provided at the time of making an application for initial or renewed registration based on a NESA risk assessment approach.
The amended Manuals reference the NESA registration website (RANGS) where supplementary materials are available. These include:
- a NESA Financial Viability Framework
- templates for a certification or warrant of a school’s financial viability by a NESA approved body or person
- an overview of the NESA risk assessment approach for financial viability including risk categories and the associated evidence required with regard to financial viability.
The amendments apply to section 3.9.4 of the Manual for individual non-government schools and section 5.9.4 of the Manual for systemic non-government schools.
The amended Manuals take effect with the publication of this Official Notice.

Official Notice BOSTES 49/16 provides notice of amendments to the Registered and Accredited Individual Non-government Schools (NSW) Manual and Registration Systems and Member Non-government Schools (NSW) Manual (‘the Manuals’).
The amendments follow the passing of legislation to establish the NSW Education Standards Authority (‘the Authority’), including changes to the legislation underpinning school registration.
The amendments relate to:
- replacing the good character requirement with a fit and proper person requirement (section 3.9.1 of the individual schools manual/5.9.1 of the systemic schools manual)
- a new financial viability requirement (section 3.9.4/ 5.9.4)
- a greater focus on the quality of teaching and student learning (section 3/5)
- the risk based approach of the Authority (section 2.4.2/ 2.3.6)
- changing references from 'the BOSTES' to 'the Authority' and other minor edits (various sections).
The Manuals constitute the rules of the BOSTES which, under legislated savings and transitional arrangements, continue to apply when the Authority commences on 1 January 2017. The amendments to the Manuals take effect on 1 January 2017.

Official Notice BOSTES 1/16 provides notice of amendments to the Registered and Accredited Individual Non-government Schools (NSW) Manual and Registration Systems and Member Non-government Schools (NSW) Manual.
For systemic schools, the amendments provide further guidance in relation to the requirement to have and implement policies and procedures for proper governance (section 5.9.3 of the systemic schools manual).
Other amendments, as listed below, apply to all non-government schools. These amendments:
- require non-government schools to have a TAA approved under the BOSTES' new regulatory framework according to the transition period published on the BOSTES website (section 3.2.1 of the individual schools manual/5.2.1 of the systemic schools manual)
- clarify that the purpose of notifying the BOSTES of an intention to deliver all or a significant majority of courses by distance education is to seek approval prior to commencing delivery by distance education (section 3.3.3, 3.9.4/5.3.3)
- strengthen the requirement relating to child protection by requiring that staff are informed annually of their legal responsibilities in relation to child protection (section 3.6.1/5.6.1)
- require that from 1 July 2016, individual non-government schools provide the BOSTES, via RANGS Online, with details of the school's 'responsible persons' including the name, role, date of commencing in the role and date of ceasing in the role within 28 days of any change (section 3.9.3.1) and that systems retain equivalent information (section (5.9.3.1) (Note: BOSTES will write to individual non-government schools in 2016 with advice about using RANGS Online to provide details of ‘responsible persons’)
- amend the requirement for professional learning of 'responsible persons' in relation to governance from a mandatory four hours per year to a mandatory 12 hours over each three year period from the time of commencing as a 'responsible person' (section 3.9.3.4/5.9.3.4)
- clarify that the maintenance of registers for professional learning and induction of 'responsible persons' are for a period of seven years from the date of each entry (section 3.9.3.4, 3.9.3.5/5.9.3.4, 5.9.3.5)
- clarify that BOSTES is to be notified if the contract or arrangement with the school's external auditor is terminated prior to the expiry of the term of the contract (section 3.9.3.6/5.9.3.6)
- clarify that a school's current compliance will be considered in assessing an application from the school for the addition of new years of schooling or for initial accreditation (section 4.1, 6.1/6.1, 8.1)
- provide further guidelines for proposed new non-government schools in relation to the required policies and procedures for proper governance (section 4.1.9/6.1.9).
The amendments to the Manuals take effect with the publication of Official Notice BOSTES 1/16.

Official Notice BOSTES 24/14 provides notice of amendments to the Registered and Accredited Individual Non-government Schools (NSW) Manual and the Registration Systems and Member Non-government Schools (NSW) Manual.
The amendments relate to the requirement for non-government schools to have policies and procedures for the proper governance of the school in place.
For individual schools, Section 3.9.3 of the Manual details this requirement, including the need for policies and procedures relating to:
- governance of the school
- conflict of interest
- related party transactions register
- professional learning for ‘responsible persons’
- induction process for new ‘responsible persons’
- external independent attestation audit of Annual Financial Statements
For systemic schools, Section 5.9.3 of the Manual provides that systemic non-government schools are required to have policies and procedures in place for the proper governance of the school that are similar to those required for individual non-government schools, and that further guidance in this regard will be developed by the BOSTES in consultation with key stakeholders.
The amendments take effect with the publication of Official Notice BOSTES 24/14 .

Official Notice BOS 15/12 provides notice of amendments to the Registered and Accredited Individual Non-government Schools (NSW) Manual and the Registration Systems and Member Non-government Schools (NSW) Manual.
The most significant amendment is the requirement, as part of providing a safe and supportive environment, for a registered non-government school to have policies and procedures with specific reference to anti-bullying and to provide a summary of these policies and procedures in the school's annual report.
Other amendments relate to:
- replacing the term 'special provisions' with 'disability provisions'
- new work health safety (WHS) laws which replaced the occupation health and safety laws in January 2012.
The amendments take effect with the publication of Official Notice BOS 15/12.

BOS 13/11
Official Notice BOS 13/11 provides notice of amendments to the Registered and Accredited Individual Non-government Schools (NSW) Manual and the Registration Systems and Member Non-government Schools (NSW) Manual.
The main amendments relate to new delegations from the Minister for Education in relation to student attendance (Section 3.8 of the Individual Manual and Section 5.8 of the System Manual).
Other amendments include updated references to child protection legislation, updated evidence of compliance regarding the requirement for teaching staff and a range of minor edits.

Amendments to the Manual
BOS 05/10
Official Notice BOS 05/10 provides notice of amendments to the Registered and Accredited Individual Non-government Schools (NSW) Manual and the Registration Systems and Member Non-government Schools (NSW) Manual.
The main amendment relates to changed reporting measures required of school annual reports (Section 3.10.1 of the Individual Manual and Section 5.10.1 of the System Manual). It is important that all non-government schools note the changed reporting requirements and take the steps necessary to ensure that annual reports on the 2009 school year reflect the changes.
Other amendments relate to updated information with regard to teaching staff (Section 3.2.1 of the Individual Manual and 5.2.1 of the System Manual), clarification of information and correction of typographical errors. The official notice specifies the sections of the manuals that have been amended.
The amendments take effect with the publication of the Official Notice (05/10).

Amendments to the manuals - Education Regulation 2007
BOS 14/08 (Vol 17 No 1)
Official Notice BOS 14/08 provides notice of amendments to the Registered and Accredited Individual Non-government Schools (NSW) Manual and the Registration Systems and Member Non-government Schools (NSW) Manual with regard to the Education Regulation 2007.
The Regulation provides for the registration of a school to cease if the school closes or the registration to be limited if the school ceases to operate. A non-government school is required to notify the Board of Studies if it closes or ceases to operate.
The Official Notice specifies the sections of the manuals that have been amended.
The amendments take effect with the publication of the notice (BOS 14/08).

Amendments to the manuals – Disability Discrimination Act 1992
BOS 42/07 (Vol 16 No 3)
Official Notice BOS 42/07 provides notice of amendments to the registration manuals with regard to the Commonwealth’s Disability Discrimination Act 1992 and the Disability Standards for Education 2005. These amendments relate to the premises and buildings of non-government schools, including boarding facilities, and to the requirement for notifying the Board of Studies in certain circumstances.
The amendments are presented in sections 3.4, 3.9.3 and 3.11.2 of the Registered and Accredited Individual Non-government Schools (NSW) Manual and sections 5.4, 5.9.3 and 5.11.2 of the Registration Systems and Member Non-government Schools (NSW) Manual.
The amendments take effect with the publication of the notice (BOS 42/07).

BOS 42/06 (Vol 15 No 5)
Official Notice BOS 42/06 provides notice of amendments to the registration manuals with regard to additional and revised requirements for annual reporting.
The amendments are presented in section 3.10.1 of the Registered and Accredited Individual Non-government Schools (NSW) Manual and section 5.10.1 of the Registration Systems and Member Non-government Schools (NSW) Manual.

Amendments to the manuals – outsourced courses
BOS 44/05 (Vol 16 No 3)
Official Notice BOS 44/05 provides notice of amendments to the registration manuals with regard to outsourced courses. The amendments provide for the Board to approve, in exceptional circumstances, the outsourcing of more than a minority of courses from a student’s pattern of study.
The amendments are presented in section 3.2.3 of the Registered and Accredited Individual Non-government Schools (NSW) Manual and section 5.2.3 of the Registration Systems and Member Non-government Schools (NSW) Manual.

BOS 04/09
Individual non-government schools and registration systems are invited to apply for:
- renewal of registration
- initial registration of new Years of schooling to commence in 2010
- initial registration of new schools seeking to commence in 2010.
Applications are due by 31 March 2009 and are required to be submitted through RANGS Online. (See Official Notice - Registration applications - a reminder)

Annual reports for the 2009 school year due 30 June 2010
BOS 20/10
All non-government schools are required to produce and publicly disclose a 2009 annual report by 30 June 2010.
The annual reporting requirements are detailed in Section 3.10.1 of the Registered and Accredited Individual Non-government Schools (NSW) Manual and Section 5.10.1 of the Registration Systems and Member Non-government Schools (NSW) Manual.
A copy of the report must be submitted through the RANGS Online facility by 30 June 2010. (see Official Notice)

The information provided details of the process for submitting an annual report for the 2007 school year.
Attached to the information was further advice to explain some of the requirements that were new in 2007. Schools may find this advice helpful in preparing a report for the 2007 school year.
